On 22 May 2015, after several months of awaiting, the text of the Regulation of the Council of Ministers of 20 April 2015 concerning the application for qualification procedure was published in the Journal of Laws (Journal of Laws of 2015, item 708). The regulation came into force as of 23 May 2015.
The Regulation contains a specimen of the application for qualification procedure for entities seeking to obtain a concession for the prospecting for, exploration and exploitation of hydrocarbons, as well as the requirements concerning the documents to be attached to the application.
The list of appendices which need to be enclosed to the application is a long one and it contains, among other things:

financial statements of the applicant for the last three years with an opinion of a certified auditor and an audit report;

current by-laws, articles of association or a different kind of document serving as the basis for the applicant’s operations;

documents presenting the capital structure and organization of the applicant and their capital group.
It should be noted that for documents drawn up in a foreign language, the translation of such documents prepared by a sworn translator also needs to be enclosed.
