We have recently written about delays in the adopting of implementing regulations to the amended Geological and Mining Law Act, including, in particular, about the lack of one of the most significant regulations concerning the application for qualification procedure.
The website of the Government Legislation Centre shows information that the subject regulation was submitted as circular on 20 April 2015 to the Polish Council of Ministers.
However, the regulation has not yet been submitted for signature to the President of the Council of Ministers. Only after this is done, namely after signing the resolution, will it be submitted for publication. The regulation will come into force on the date of its publication. It is already worth to become familiar with its provisions.
In particular, it is useful to get to know the list of appendices which the entrepreneur seeking to obtain the concession for prospecting for, exploration and exploitation of hydrocarbons will have to enclose with the application for qualification procedure. The rules are also applicable to entrepreneurs which are currently holders of a prospecting or exploration concession, and will seek to transform the concession or prolong the period of its validity.
